Busted by ABC and Berkeley Cops!!!Only a month and a half after Spud's finally got its beer and wine license, it got busted in a police sting for selling alcohol to a minor Decoy. It happened on a busy Saturday afternoon when Spud's was short staffed and under pressure to serve everyone in a timely manner. Berkeley Police has received funds from the State Department of Alcoholic Beverage Control (ABC) to conduct decoy operations at establishments selling alcohol. On the day that we had our visit from Berkeley's finest, 16 other establishments were visited, out of which a total of seven were busted. The Police Decoy entered and served himself to a beer from our drink cooler. Andrew, "The Boss", was in charge of the cash register. Andrew assumed that the decoy had been ID-d earlier in the afternoon and accepted the Decoy's money. Ooops!!! - Berkeley Police then cited Andrew and photographed him with the underage Decoy holding the Beer, while pointing at the Boss, as if to say "That's the unsavory character who tried to lead me into temptation....". A series of Alameda County Court hearings followed over Andrew's misdemeanor charge, with the final result of the charge being dismissed. In the words of the Judge: "...in the interest of justice...". Andrew, however, was not so lucky with the Alcohol Beverage Control Board. In the ABC initiated hearing, an Administrative Law Judge ruled against Spud's and imposed a 15 day ban against Spud's selling alcohol. Since our bust we have religiously ID-d everyone and guess what?! Never an underage attempt to purchase alcohol! People buy a beer or two to go with their pizzas, but we do not have any real drinkers The fact of it is, though we are the victims of it, we do not object to the program. Underage drinking is a major problem and a large cause of violence and auto accidents. Our experience has taught us a lot and made us more professional, but we cannot but wish that it all happened with one of the many troublesome liqueur stores and not us. |
